Final Mental Health Parity Rules Issued

The Departments of Labor, Health and Human Services and the Treasury (collectively, the Departments) have released final Mental Health Parity and Addiction Equity Act (MHPAEA) rules.

These final rules respond to comments and finalize requirements pursuant to the proposed MHPAEA regulation that was issued by the Departments last summer, which we summarized in our August 1, 2023 insight. The Departments consider this a significant step in their ongoing efforts to promote access to mental health and substance use disorder benefits.

We’ll issue a detailed review of the final rules following their official publication in the Federal Register. That version will be the official, approved document.

In addition to the final rules, the Departments issued a press release, a fact sheet and one-page documents for plans and issuers, consumers and providers.
